Fines for Failing to Comply
Since the 1st July of 2021, if a new or renewed tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance work have to be completed within 90 days.
From the 1st of July in 2021, if a new or renewed lease is entered into on the Aro Valley rental property, all Healthy Homes compliance work must be finished inside of 90 days.
Failure to adhere to all of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated in the renewal, new or amended tenancy agreement there could be an additional penalty or infringement fee.
Anyone can request information about the Healthy Homes Standard and how they relate to the property they live in. If the landlord or property manager fails to supply the information requested within 21 days from being informed of the request, they can receive an infringement notification and be fined up to $750.
In addition, there is an additional fine of as much as $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or other information. The person responsible for this fine is the person who is named on the tenancy agreement as the person who is leasing the property out, so it could be the name of the landlord as well as the company that manages the property.
The information contained in the Statement of Compliance requirements to be up-to-date when the tenancy agreement is completed, and must be updated throughout the tenancy as any related work is completed.
It’s also important to note that landlords who own multiple rental properties could face additional fines for non-compliance. The most severe penalties are given for serious breaches. Landlords with at least six rental properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.
