Fines for Failing to Comply

As of 1st July 2021, when a brand new or renewed contract is signed on an Aro Valley rental property, all Healthy Homes compliance tasks need to be completed within 90 days.

Since the 1st July of 2021, if a new or renewed contract is signed on an Aro Valley rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with each of Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy contract, it could result in an additional fine or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they are related to the house they reside in. If the property manager does not provide the required information within 21 days from receiving the request, they will receive an infringement letter and be fined up to $750.

Furthermore, there’s also a fine of up to $900 for landlords or property managers providing a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance requirements to be correct when the tenancy contract is signed, and ideally it should be kept updated through the tenancy period as associated work has been completed.

It is also crucial to keep in mind that landlords who manage several rental properties can face additional fines for non-compliance. The highest penalties are given for severe violations. Those who have more than six properties could be fined as high as $50,000 and as high as $100,000 in hearings.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory throughout Aro Valley and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that prove compliance with all Healthy Homes Standards that apply or will be applicable during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers have to ensure their rental properties comply to the Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of when the tenancy began.

If you can feel external air getting in, or see the sound of a clear draught emanating from a crack or a gap, then it is probably a gap or hole which needs sealing in any way. Cracks and gaps that are large should be sealed permanently. Cracks that are greater than 3mm and let air in or out of the house need the sealing. In the case of an open fireplace isn’t being used, it can cause draughts and should be shut off. Property managers and landlords are responsible for ensuring such draughts are eliminated in the maximum extent imaginable.

There is no need to block up intentional gaps or holes which are part of the construction. For instance, small gaps around windows and doors may be required to allow for movement of the structure when the household heats and cools, in order to let them be shut and opened, rather instead of being stuck. Heating Aro Valley

Aro Valley rental properties require a reliable source of heat that can warm the principal or the biggest living room to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs for it to be permanent (i.e. not portable) and at least 1.5 kW of heating capacity, and it must have the minimum required heating capacity for the main living room. Ventilation Aro Valley

Ceiling and underfloor insulation is a requirement to all rental homes since July 1, 2019. Property managers and landlords should ensure that the insulation is up to standards that are in line with the latest quality.
