Fines for Failing to Comply
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance work need to be done inside of 90 days.
Beginning on July 1st, 2021, when a brand new or renewed Tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.
Failure to adhere to one of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy contract, it could result in an additional fine or violation fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or property manager is unable to supply the necessary information within 21 days of receiving the request, they could receive an infringement letter and be fined up to $750.
Furthermore, there’s also a fine of up to $900 for property owners or property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is whoever is identified on the tenancy agreement as being the person renting the property which could be the name of the landlord, or the company that manages the property.
The information contained in the Compliance Statement needs to be correct when the tenancy contract is signed. It should be maintained throughout the duration of the tenancy when any relevant work gets completed.
It’s important to note that landlords who manage several rental properties can face greater penalties for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with six or more properties could receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.
