Fines for Failing to Comply
Since the 1st July of 2021, once a new, renewed or varied contract is signed on an Aro Valley rental property, all Healthy Homes compliance work have to be taken care of inside of 90 days.
Beginning on July 1st, 2021, when a new or renewed Tenancy is signed for the Aro Valley rental property, all Healthy Homes compliance work must be finished by the end of 90 days.
Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy contract, there could be an additional penalty or infringement fee.
Any tenant can ask for details about the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t supply the information requested within 21 days of having received the inquiry, they can receive an infringement notification and could be fined up to $750.
Additionally, there is an additional fine of up to $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is named on the tenancy agreement as being the person renting the property and it could be the name of the landlord or the company that manages the property.
The information contained in the Compliance Statement requirements to be correct at the time that the tenancy agreement is completed, and should be kept updated during the entire tenancy, as necessary work related to it is finished.
It’s crucial to remember that landlords who manage multiple rental properties may receive more severe penalties for not complying. The most severe penalties are reserved only for serious violations, and landlords who own six or more properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.
