Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed contract is signed on an Aro Valley rental property, all Healthy Homes compliance work have to be done inside of 90 days.

Since the 1st July of 2021, if a new or renewed lease is entered into on an Aro Valley rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager does not supply the required information within 21 days from having received the inquiry, they may be issued an infringement notice and be fined as high as $750.

Additionally, there is also a penalty of up to $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is identified on the tenancy contract as the person renting the property, so it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be correct when the tenancy contract is signed. It must be updated throughout the tenancy as any associated work has been completed.

It is crucial to note that a landlord who manage multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for serious breaches, and landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 for hearing claims.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement for all Aro Valley and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records of their compliance with any Healthy Homes Standards that apply or will be applicable to an apartment rental.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties conform according to Healthy Homes Standard within 90 days of any new, renewed or varied tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All households which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Aro Valley

Rental properties in Aro Valley need to have a stable source of heating that can heat the largest or main living room to at least 18degC even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental outlook.

The source of heat requirements for it to be permanent (i.e. not portable) and at minimum 1.5 Kilowatts in heating capacity, and must meet the minimum required heating capacity for the main living space. If the heating system you provide is electric heating or heat pump it needs to include a thermostat. This will make the heating more reliable and efficient. For most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. In certain situations, such as small apartments, a smaller fixed electric heater may be sufficient.

If your main living space already has a fixed heating source such as an air conditioner, it may need a top up to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the quality since they’re either expensive, inefficient and/or unsafe to run.
