Did you have any idea that the Healthy Homes Standards came into in force on July 1, 2021? Landlords now have to make sure that their Aro Valley rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy and all private rental properties are required to be fully compliant by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for an Aro Valley rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Since the 1st July of 2021, once a new or renewed Tenancy is signed for the Aro Valley rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or amended tenancy agreement there may be an additional penalty or infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the home they live in. If the property manager fails to provide the necessary information within 21 days of having received the inquiry, they will receive an infringement notification and be fined up to $750.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers that provide false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is named on the lease contract as the person who is letting the property, so it could be the name of the landlord or the company that manages the property.

All information in the Compliance Statement needs to be correct when the tenancy contract is signed, and ideally it should be kept updated through the tenancy period as associated work has been completed.

It’s important to keep in mind that a landlord who have multiple rental properties may receive even higher fines for non-compliance. The highest penalties are handed down only for serious violations. Those who have at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is mandatory to all Aro Valley and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Property managers and landlords must keep records that prove compliance with each Healthy Homes Standards that apply or will be applicable during the tenancy of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding household tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals homes have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.

What are unreasonable gaps and holes?

If you can feel external air coming in or a clear draught from a crack or a gap or crack, then it is probably a gap or crack that needs sealing in some way. Large cracks and gaps should be stopped permanently. Any gaps greater than 3mm that let air into or out into your home need to be sealed. For example, if the open fireplace is not in use, it could cause draughts, and should be sealed off. Property managers and landlords are responsible for ensuring that draughts from the fireplace are removed as far as possible.

There is no require to block holes or gaps in the construction. Heating Aro Valley

Aro Valley rental properties require a reliable source of heat that is able to heat the principal or the biggest living space to at least 18degC, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat requirements for it to be permanent (i.e. not portable) that is, at minimum 1.5 kW of heating capacity, and it must have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool could be used to check if the existing installed heater(s) are sufficient or if you’ll require to "top up" with an additional heater. Open fires as well as unflued combustion heaters, such as the portable LPG bottle heaters aren’t considered to be suitable heating options for those following the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat pump it should include the thermostat. This will make the heating more reliable and effective. For most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in certain instances like apartments with small spaces the smaller fixed electric heater could be enough.

If your main living space already has a permanent heating source such as the heat pump, it could require some additional energy to make sure it meets the requirements. Some types of heaters can’t be used to meet the quality since they’re either costly, not affordable to run, and/or unsafe to run.

Ventilation Aro Valley

Underfloor and ceiling insulation has been compulsory in all rental homes from 1 July 2019. All landlords and property managers are required to make sure that the insulation is up to standards that are in line with the latest standard.
