Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into in force on July 1, 2021? Landlords are now required to make sure their Aro Valley rental properties meet the minimum Healthy Homes Standards within 90 days of any renewal or new tenancy and all private rentals must be fully compliant by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied contract is signed on an Aro Valley rental property, all Healthy Homes compliance items must be finished within 90 days.

As of 1st July 2021, once a new or renewed contract is signed on an Aro Valley rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with any of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included in a new, renewed or amended tenancy agreement it could result in additional penalties or an infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or the property manager doesn’t supply the information requested within 21 days of getting the notice, the tenant will receive an infringement notification and be fined up to $750.

Additionally, there is an additional fine of approximately $900 for property owners or property managers providing a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the one who is named on the lease contract as the person who is letting the property and it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be maintained throughout the tenancy as any related work is completed.

It’s also important to keep in mind that landlords who manage several rental properties can face more severe penalties for not complying. The highest penalties are reserved for serious breaches. Landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 for hearing claims.

When Do I require to be in compliance with my Healthy Homes Standards?

Aro Valley Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement to all Aro Valley and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Landlords and property managers must keep records that demonstrate compliance with all Healthy Homes Standards that apply or will apply during the tenancy of an apartment rental.

From July 1st 2021

  • Private landlords and property managers have to make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding home tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All households that are rented out to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draughts increase the likelihood of less temperature in homes. A damp house will cost more to heat, resulting in wasted energy and resulting in higher bills.

If a draught can be perceived as a result of gaps or holes, it requirements to be sealed.

What are unjustifiable gaps or holes?

If you can feel external air flowing in or a clear draught out of a hole or gap and you can feel it, it’s probably a gap or crack that needs sealing in somehow. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that let air into or out into the house need to be sealed. For instance, if an open fireplace isn’t in use it can create draughts. This should be blocked off. Landlords and property managers are accountable for ensuring such draughts are eliminated as much as imaginable.

There is no need to block gaps or holes that are part of the building. For example, tiny gaps around doors and windows could be necessary to allow for movement of the structure as the house is heated and cools in order to let them be closed and opened rather than being stuck. Heating Aro Valley

Aro Valley rental properties must have a fixed source of heat that can warm the principal or the biggest living room to at least 18degC even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements for it to be permanent (i.e. not portable) with at least 1.5 kW in heating capacity, and meet the minimum required heating capacity in the living area. A Heating Assessment Tool can be used to check if your current permanent heater(s) are adequate or if you’ll need to "top up" by adding a second heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating system you offer is an electric heater or heat source, it requirements to be equipped with a thermostat. This will help make the heating more uniform and effective. For most homes, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases such as small apartments small apartments, a smaller electric fixed heater may suffice.

If your main living space already has a fixed heating source, like an air conditioner, it could need some additional energy to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard since they’re either not efficient, cost prohibitive to operate and/or unhealthy to run.

Ventilation Aro Valley

Insulation Aro Valley

Underfloor and ceiling insulation is mandatory on all rental houses from 1 July 2019. All landlords and property managers should ensure that the insulation is up to current standard. In some cases, an existing insulation on the ceiling or in the sub floor space may require to be topped up or replaced.

A house that is well-insulated can reduce condensation and lessen the likelihood of mould and damp, and will also make it easier to allow the home to hold the heat.
