Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed on an Aro Valley rental property, all Healthy Homes compliance items need to be done within 90 days.

As of 1st July 2021, if a new or renewed lease is entered into on the Aro Valley rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to meet all of the Healthy Homes Standards within the deadlines can result in penalties of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy contract, there could be an additional fine or infringement fee.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is mandatory in all Aro Valley and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords are required to keep records of their the compliance with all Healthy Homes Standards that apply or will be applicable during the tenancy of the rental property.

From July 1st 2021

  • Property managers and private landlords have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any new, renewed or varied Tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All houses that are rented out from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Aro Valley

Rental properties in Aro Valley require a reliable source of heat that can warm the living area to at minimum 18degC, even on the most coldest days of the year. In some instances, such as small apartments the smaller fixed electric heater may be sufficient.
