Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on an Aro Valley rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on the Aro Valley rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

It’s also crucial to note that landlords with multiple rental properties could face even higher fines for non-compliance. The highest penalties are given for the most serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Aro Valley Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement to all Aro Valley and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Property managers and landlords must keep records that prove the compliance with the Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

From 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarder households (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must meet the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

For instance, small gaps around doors and windows could be necessary to allow movement of the building when the house is heated and cools so that they are able to be opened and closed rather instead of being stuck. Heating Aro Valley

Aro Valley rental properties should have a permanent heating source that is able to heat the living area to at minimum 18 degrees Celsius, even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The heating source needs for it to be permanent (i.e., not portable) and at minimum 1.5 kW of heating capacity, and must meet the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool can be used to determine if the existing fixed heater(s) are adequate or whether you will need to top up with a new heater. Unflued combustion and open fire heaters such as mobile LPG bottle heaters are not considered to be suitable heating options in those following the Healthy Homes Standard.

If the heating that you offer is an electric heater or heat pump then it must be equipped with a thermostat. This will make the heating more consistent and efficient. For most properties, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater may suffice.

If the main living room is already equipped with a fixed heating source, like a heat pump, then it could need a top up to meet the standards. Certain kinds of heaters cannot be used to achieve the standard as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Aro Valley

Every living space of a rental property must contain at minimum one open window or exterior door to offer natural airflow. In addition, high moisture areas such as kitchens or bathrooms should have an externally vented extractor fan that can take moisture away.

Underfloor and ceiling insulation is a requirement in all rental homes since 1 July 2019. All landlords and property managers must make sure that the insulation is in line with the new quality.
