Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied contract is signed on an Arakura rental property, all Healthy Homes compliance tasks need to be taken care of inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on an Arakura rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t included in the new, renewed or revised tenancy agreement there may be an additional fine or violation fee.

Any tenant may request details regarding the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to provide the necessary information within 21 days from being informed of the request, they may receive an infringement notice and be fined up to $750.

Additionally, there is also a penalty of approximately $900 for landlords and property managers who have provided a false or misleading Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the person who is named on the tenancy agreement as the person who is who is letting the property and it could be the name of the landlord, or the company that manages the property.

The information contained in the Statement of Compliance requirements to be up-to-date when the tenancy contract is signed, and ideally it must be updated throughout the duration of the tenancy when any relevant work gets completed.

It’s crucial to note that a landlord who manage multiple rental properties may face additional fines for non-compliance. The harshest penalties are given for the most serious violations, and landlords who own six or more properties could be fined up to $50,000, and as much as $100,000 in hearings.

When do I require to be in compliance with requirements of the Healthy Homes Standards?

Arakura Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is required for all Arakura and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records to demonstrate the conformance to the Healthy Homes Standards that apply or will be applied during the tenure of your rental home.

From 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) must adhere to the Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Arakura

Arakura rental properties must have a fixed source of heating that can heat the living space to a minimum of 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heating needs to remain fixed (i.e. not portable), at least 1.5 Kilowatts in heating capacity and have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool may be used to determine whether your current installed heater(s) are sufficient or whether you will need to ‘top up’ with an additional heater. Open fires and unflued combustion heaters like mobile LPG bottle heaters are not considered to be acceptable heating options for the Healthy Homes Standard.

If the heating system you provide is an electric heater (or heat pump), then it must be equipped with a thermostat. This makes the heating more consistent and efficient. For most houses, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In some instances, like apartments with small spaces, a smaller fixed electric heater may suffice.

If the living area already has a fixed heating source, like an air conditioner, it may need an upgrade to meet the standards. Certain types of heaters cannot be utilised to meet the standard because they’re not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Arakura

Every living space of the rental property should contain at minimum one open doors or windows to provide natural airflow. Furthermore, moist spaces like kitchens and bathrooms must have a suitable externally vented extractor fan to remove moisture.
