Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on an Arakura rental property, all Healthy Homes compliance tasks have to be completed inside of 90 days.

Since the 1st July of 2021, when a brand new or renewed Tenancy is signed for the Arakura rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement there may be an additional fine or violation fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they live in. If the property manager fails to supply the information requested within 21 days of having received the inquiry, they may be issued an infringement notice and could be fined up to $750.

In addition, there is an additional fine of approximately $900 for property owners or property managers that provide false or false Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the tenancy agreement as the one who is leasing the property out and it could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and is updated during the entire tenancy, as necessary work related to it is finished.

It is also crucial to be aware that a landlord who have multiple rental properties could face more severe penalties for not complying. The most severe penalties are handed down for severe violations, and landlords who own six or more properties could be fined up to $50,000, and as much as $100,000 in hearing claims.

Arakura Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is mandatory throughout Arakura and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that prove the compliance with all Healthy Homes Standard that apply or will be applicable throughout the tenancy period of an apartment rental.

From 1 July 2021

  • Private landlords and property managers should make sure their rental properties comply to the Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2023

  • All houses rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standard regardless of when the tenancy first began.

However, in some cases such as small apartments, a smaller fixed electric heater might be enough.
