Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed for an Arakura rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

Since the 1st July of 2021, if a new, renewed or varied lease is entered into on the Arakura rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy agreement, there may be additional penalties or an infringement fee.

Anyone can request details about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager is unable to provide the information requested within 21 days from being informed of the request, they could be issued an infringement notice and be fined up to $750.

Furthermore, there’s also a penalty of as much as $900 for property owners or property managers who offer a false or incorrect Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is the one who is named on the lease agreement as being the person leasing the property out and it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be current before the tenancy agreement can be signed. It should be maintained during the entire tenancy, as necessary work related to it’s finished.

It is also crucial to keep in mind that landlords with multiple rental properties may face additional fines for non-compliance. The highest penalties are given for serious breaches. Landlords with six or more properties can be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.

Healthy homes matter

What is the reason Healthy Homes Compliance So Important?

A majority of households rent the property in New Zealand and Arakura, and research suggests that rental houses are likely to be colder, older and have less efficient heating, and generally are of lower quality than owner occupied properties.

Damp, mouldy and cold homes are linked to negative well-being results, specifically for ailments like colds and flu, asthma and heart diseases. In addition, people who experience at least four major home quality issues often suffer from lower levels of satisfaction with life and a decrease in mental health.

Enhancing the standard of Arakura rental property will help tenants experience improved mental and physical health and minimise the disruption to work, learning and daily life because of diseases. Your investment is also better protected from mould, mildew and damp-related damage, which results in less costs of maintenance over the long term.

The Healthy Homes Standard is a set of specific and minimal requirements for heating, insulation Ventilation and Ventilation and Drainage, as well as Draught Stopping for Arakura rental properties.

Unreasonable Gaps & Holes

Draught Stopping Arakura

Draughts increase the likelihood of lower temperatures in homes. A damp home is more expensive to heat, which means wasting energy and increased bills.

If a draught could be perceived as a result of gaps or holes that it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air coming in or the sound of a clear draught emanating from a gap or hole or crack, then it’s probably a gap or crack that needs sealing in the way you can. Cracks and gaps that are large should be sealed permanently. Gaps greater than 3mm that let air into or out into your house require the sealing. For instance, if an open fireplace is not in use, it can cause draughts and must be sealed off. Property managers and landlords are accountable for making sure that these draughts are stopped as far as imaginable.

You don’t require to block off gaps or holes that are part of the construction. For instance, small gaps around windows and doors could be necessary to allow for movement of the building when the home heats and cools, in order to let them be shut and opened, rather instead of being stuck. We will check the windows and doors as part of our Healthy Homes assessment of your rental property.

Heating Arakura

Arakura rental properties need to have a stable source of heating that is able to heat the living room to at least 18degC even on the coldest winter days. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heating requirements for it to be permanent (i.e. not portable), at least 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool can be used to determine if the existing installed heater(s) are sufficient or if you’ll need to top up by adding a second heater. Open fires and unflued combustion heaters like portable LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating you offer is an electric heater or heat pump it requirements to be equipped with an thermostat. This will help make your heating more consistent and efficient. For most homes, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in some cases like apartments with small spaces, a smaller fixed electric heater might be enough.

If your main living space already has a central heating source, like the heat pump, it could require a top up in order to comply with the standards. Some types of heaters can’t be used to comply with the quality since they’re either costly, not affordable to run, or unsafe to operate.

Ventilation Arakura

Each liveable space in a rental property must have at least one opening windows or an exterior door to offer natural ventilation. Additionally, areas with high moisture areas like kitchens and bathrooms should be equipped with an venting fan outside to remove moisture.

This ventilation quality is all about acknowledging how dry air will be more easy to heat and that the property that is properly ventilated is less likely to develop mould and damp.

Bedrooms, living rooms, kitchens, and dining areas are considered to be liveable spaces. Spaces that connect, such as the hallway are not considered liveable , and thus do not need an opening door or window.

Each door, window or the skylight needs to have the ability to open up to the outside, and stay fixed in an open position to allow ventilation and fresh air air flow.

The bathrooms in all kitchens as well as any other space in your property with a bath, shower, cooktop or other high humidity-generating items will require suitable extractor fans that are vented out to the outside. The Healthy Homes Assessment service will ensure that there is sufficient ventilation in every living space that includes extractor fans that are suitable for areas that are high in moisture.

Insulation Arakura

Ceiling and underfloor insulation has been compulsory in all rental homes since July 1, 2019. All landlords and property managers must ensure that the insulation is up to current standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space might require to be replaced or replaced.

A properly insulated home will reduce the risk of condensation and lower the chance of mould and dampness, and also makes an easier task to the household to keep the heat.

Insulation requirements to be in compliance with the R-values of your area.

The "R" is a symbol for thermal resistance, and is a gauge of how well the insulation withstands heat flow. The more R-value is higher, the more efficient the insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9, underfloor R 1.3
  • Zone 2 – the rest of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Arakura Moisture Ingress & Drainage

Protecting your rental property from moisture isn’t just about what’s inside the building It’s about having to make sure there is somewhere for surface and underground water to flow and prevent it from getting inside. When it is about damp and water, it’s frequently those concerns that you aren’t aware of that could be a huge problem that can cause the property to suffer and harming your tenant’s health.

Rental properties require to have effective drainage to get rid of the stormwater and surface waters, and groundwater, with an appropriate outfall or runoff. Making sure that the water has a location to go and that it isn’t allowed to remain beneath buildings is a vital aspect of making sure your property is dry.

In addition to a drainage system to prevent moisture ingress, if your apartment has an enclosed gap between floorboards and soil, a ground-water barrier must be put in place when it is reasonably practicable to install it.

A ground moisture barrier is usually a polythene sheet laid over the ground, in order to block any moisture from the ground from accumulating into the building. It also helps in preventing moisture damage to the underfloor insulation.
