Fines for Failing to Comply

As of 1st July 2021, once a new or renewed contract is signed on an Arakura rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for an Arakura rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

The person who is responsible for this fine is whoever is named on the tenancy agreement as the person who is letting the property out It could also be the landlord’s name or the company that manages the property.

Arakura Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory throughout Arakura and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Landlords and property managers must keep records that prove compliance with each Healthy Homes Standards that apply or will apply to your rental home.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.
