Fines for Failing to Comply

It is also important to be aware that a landlord who own multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are handed down for serious breaches. Landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Arakura Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory for all Arakura and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with any Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

Starting 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties conform according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

You don’t need to cover up gaps or holes in the building. For instance, small gaps around windows and doors could be required to allow for movement of the building as the house is heated and cools in order to let them be closed and opened instead of than securing. Adequate heaters are crucial for healthy houses

Heating Arakura

Rental properties in Arakura must have a fixed source of heating that can heat the principal or the biggest living area to at minimum 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat requirements that it be permanently fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity and have the minimum heating capacity needed to heat the living space in general. A Heating Assessment Tool may be used to check if your current installed heater(s) are adequate or if you’ll need to "top-up" by adding a second heater. Open fires as well as unflued combustion heaters such as mobile LPG bottle heaters are not considered to be suitable heating options in the Healthy Homes Standard.

If the heating system you offer is an electric heater (or heat pump), then it must be equipped with the thermostat. This will make the heating more consistent and effective. For most houses, larger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater could be enough.

If the main living room already has a fixed heating source, such as heat pumps, it could require a top up to be able to meet the standards. Certain kinds of heaters cannot be utilised to meet the standard because they’re expensive, inefficient or unsafe to operate.
