Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for an Arakura rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on the Arakura rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

The person who is liable for this fine is the one who is listed on the tenancy agreement as being the person renting the property and it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be up-to-date when the tenancy agreement is signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It’s crucial to be aware that landlords with multiple rental properties could face greater penalties for non-compliance. The most severe penalties are handed down for severe violations, and landlords who own six or more properties can be fined as high as $50,000, and even as high as $100,000 for hearing claims.

Arakura Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory for all Arakura and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate compliance with any Healthy Homes Standards that apply or will apply during the tenure of their rental properties.

From July 1st 2021

  • Property managers and private landlords should make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any newly renewed, extended or changed Tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Starting 1 July 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental houses must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Adequate heaters are important to ensure healthy houses

Heating Arakura

Rental properties in Arakura must have a fixed source of heating that is able to heat the largest or main living space to a minimum of 18 degrees Celsius, even on the winter coldest days.
