Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed on an Arakura rental property, all Healthy Homes compliance work need to be completed inside of 90 days.

Beginning on July 1st, 2021, once a new or renewed contract is signed on an Arakura rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to adhere to all of the Healthy Homes Standards within the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included in the new, renewed or revised tenancy agreement there may be an additional fine or violation fee.

Any tenant may request information about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager does not provide the necessary information within 21 days of getting the notice, the tenant could receive an infringement letter and could be fined up to $750.

Additionally, there is also a penalty as much as $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person responsible for this fine is the person who is named on the lease agreement as the person who is leasing the property out which could be the landlord’s name or the property management company.

All the information on the Statement of Compliance requirements to be accurate when the tenancy agreement is signed, and ideally it is updated through the tenancy period as related work is completed.

It’s also crucial to keep in mind that landlords with multiple rental properties could face greater penalties for non-compliance. The harshest penalties are handed down only for serious breaches. Landlords with more than six properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

Arakura Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is required throughout Arakura and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records of their the compliance with the Healthy Homes Standard that apply or will apply during the tenancy of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must meet the Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All households rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
